1. Scope
The following terms and conditions apply to all orders via our online shop.
2. Contractual partner, conclusion of contract
The purchase contract is concluded with Souleway GmbH.
By placing the products in the online shop, we are not submitting a binding offer to conclude a contract for these items, but rather are displaying our goods without obligation. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained in the order process. The order you send to us is the binding offer on your part to conclude a contract. The contract is concluded when we confirm your order by email. With the confirmation we therefore declare acceptance of your offer.
For deliveries to Switzerland, the purchase contract is concluded between the buyer and MeinEinkauf AG, St. Gallen (CHE-331.561.017 VAT). The latter also takes care of customs clearance, invoicing and delivery in Switzerland. This service is included in the purchase price and any shipping costs charged. In order to ensure smooth delivery to Switzerland, we would like to inform you for reasons of transparency that MeinEinkauf GmbH in DE-Konstanz (DE285677365) is also involved in the retail chain. This does not result in any additional costs for the buyer.
3. Statutory right of withdrawal

Within the EU you have the right to withdraw from this contract within thirty days without giving a reason. The cancellation period is thirty days from the day on which you or a third party named by you who is not the carrier took possession of the last goods. In order to exercise your right of withdrawal, you must contact us (Souleway GmbH, Danziger Straße 35A, 20099 Hamburg, support@souleway.com, phone: +49 40 53932843) by means of a clear declaration (e.g. a letter sent by post, fax or email) of your decision to withdraw from this contract. You can use the attached model withdrawal form for this purpose, but this is not mandatory. To meet the cancellation deadline, it is sufficient for you to send your notification of exercising your right of cancellation before the cancellation period has expired. We expressly point out that the right of withdrawal in accordance with § 312 g, Paragraph 2, No. 1 BGB does not apply to goods that are not prefabricated and that an individual selection or determination by the consumer (i.e. the buyer) is decisive for their manufacture or which are clearly tailored to the personal needs of the consumer (i.e. the buyer).
Consequences of withdrawal
If you withdraw from this contract, we will have given you all the payments that we have received from you, including delivery costs (with the exception of the additional costs that result from choosing a different type of delivery than the cheapest standard delivery offered by us have), to be repaid immediately and at the latest within thirty days from the day on which we received notification of your cancellation of this contract. For this repayment we use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; In no case will you be charged any fees for this repayment. We can refuse repayment until we have received the goods back or until you have provided evidence that you have sent the goods back, whichever is earlier.
You must return or hand over the goods to us immediately and in any case no later than thirteen days from the day on which you informed us of the cancellation of this contract. The deadline is met if you send the goods before the period of thirteen days has expired. You bear the direct costs of returning the goods. You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary to check the nature, properties and functionality of the goods.

4. Contract language, contract text storage
The languages available for the conclusion of the contract are German and English. We save the contract text and send you the order details by email. This order confirmation also contains a link to our terms and conditions. You can also view the terms and conditions here on this page at any time. For security reasons, your past orders are no longer accessible via the Internet.
5. Terms of delivery
We deliver free of charge within the EU. Separate tariffs apply to deliveries to all other countries. In this case, please contact our customer service: support@souleway.com. We only deliver by mail. Unfortunately, a self collection of the product is not possible.

6. Payment
The following payment methods are generally available in our shop:
Payment in advance
If you choose to pay in advance, we will give you our bank details in a separate email and deliver the goods after receipt of payment.
Credit card
When you submit your order, you also provide us with your credit card details. After your legitimation as the legitimate cardholder, we will ask your credit card company to initiate the payment transaction immediately after the order has been placed. The payment transaction is carried out automatically by the credit card company and your card is charged.
PayPal
In the ordering process you will be redirected to the website of the online provider PayPal. In order to be able to pay the invoice amount via PayPal, you must be registered there or first register, legitimize with your access data and confirm the payment instruction to us. After placing the order in the shop, we ask PayPal to initiate the payment transaction. The payment transaction is carried out automatically by PayPal immediately afterwards. You'll get more information during the ordering process.
Instant bank transfer
After placing the order, you will be redirected to the website of the online provider SOFORT Überweisung. In order to be able to pay the invoice amount via SOFORT Überweisung, you must have an online banking account with PIN / TAN that has been activated for participation in SOFORT Überweisung, identify yourself accordingly and confirm the payment instruction to us. You'll get more information during the ordering process. The payment transaction will be carried out immediately afterwards by SOFORT Überweisung and your account will be debited.
Payment by SEPA direct debit
With the SEPA direct debit procedure, you can conveniently pay for your order by automatically collecting the invoice amount from Souleway. When ordering, you can choose SEPA direct debit from our payment methods. After choosing the payment method, you can simply enter your IBAN. By submitting the shopping cart, you confirm your consent to the collection of the invoice amount.
Giropay
After placing the order, you will be redirected to the website of the online provider giropay. In order to be able to pay the invoice amount via giropay, you must have an activated online banking account with PIN / TAN procedure for participation in giropay, identify yourself accordingly and confirm the payment order to us. You'll get more information during the ordering process. The payment transaction will be carried out by giropay immediately afterwards and your account will be debited.
We only accept payments in EURO.
7. Retention of Title
The goods remain our property until full payment.
8. Transport damage
If goods are delivered with obvious transport damage, please complain about such errors to the deliverer as soon as possible and contact us immediately. Failure to lodge a complaint or contact us has no consequences for your legal claims and their enforcement, in particular your warranty rights. However, they help us to assert our own claims against the carrier or transport insurance.
9. Warranties and Guarantees
Unless otherwise expressly agreed below, the statutory right to liability for defects applies with the exception of liability in the event of compensation, which is limited under point 10 below.

We are always unrestrictedly liable for claims due to damage caused by us, our legal representatives or vicarious agents

In the event of a breach of essential contractual obligations, the fulfillment of which makes the proper execution of the contract possible in the first place and on whose compliance the contractual partner can regularly rely (cardinal obligations) through slight negligence on the part of us, our legal representatives or vicarious agents, the amount of liability is foreseeable at the time the contract was concluded Damage limited, the occurrence of which must typically be expected.

12. Discount Codes
Multiple discount codes cannot be combined for one purchase. Discount codes cannot be used for goods that have already been reduced.

Only one entry per person is scored. Any multiple entries will be excluded from the competition.
All personal information will be treated confidentially and will not be passed on to third parties.
Any entry received before 23/12/2020 at 18:00 will be considered for participation in the draw.
The winner will be drawn by lottery on 23.12.2020 and will also be informed on the same day.
